And still we wait…

It has now been 5 months since the city of Maumee Division of Inspection and Zoning stopped work by the contractor we hired to replace our foundation, and then completely abdicated their role and responsibility and any claim they may have that they care in the least about the minimum standards of health and safety for the residents of the city of Maumee.

(We know, we know… you SAY you do care about the residents… just not all of them… just not us!)

The foundation trenches excavated by Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC still surround our home in the historic district, at 321 W. Broadway.

The fence surrounding the trenches came down weeks ago and we are no longer certain if the fence is appropriate.

We are planning on repairing the foundation ourselves over the next two or three years. In that time the excavated trenches will remain as long as needed to facilitate repairs.

We dug a hole in our basement floor and we now have an automatic sump pump, that when it rains pumps the hundreds if not thousands of gallons of water that flood our basement, through a garden house out into West Broadway street.

Please let us know when you know if code enforcement is appropriate to insure the minimum standards of health and safety for us, citizens and residents of the city on Maumee.

We are now looking into our next option, in a writ of mandamus ordering Maumee government officials to properly fulfill their official duties and correct their egregious abuse of discretion.

Good day,

My name is Tim Ide and together with Megan Bremer, we have a story to tell.

Do you have a few minutes?

I will attempt to write a ‘brief’ synopsis of the story for you, with details to follow.

This story involves the city of Maumee Division of Building, Inspection and Zoning, as well as a contractor known as Toledo Basement Repair, owned by Mr. Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC.

On August 9^th 2017 Megan and I bought a house together at 321 West Broadway in historic Maumee, Ohio.

The house built in 1907 was in need of a total rehab/save, and that was and still is our intention. We are redoing everything and making it our home.

The first thing on our list was to replace the foundation under the timber framed, one and one half story structure.

In October, 2017 we contracted with Toledo Basement Repair’s sales associate Terence Lengel. We signed a contract and paid him $14,900 dollars.

On November 12 two guys from DIVERSIFIED GROUP LLC show up and begin digging. We informed them that they would need to have a permit from the Maumee Division of Building, Inspection and Zoning prior to beginning any work.

On November 16^th DIVERSIFIED GROUP LLC applied for a permit to replace our foundation under our home. The Maumee Division of Building, Inspection and Zoning on November 20th, issued the permit in direct conflict with Ohio law.

The first of two concrete pours occurred on November 29^th, for the first half of the new footer, and was inspected by Maumee Division of Building, Inspection and Zoning inspector Robert ‘Mark’ Westcott as compliant with minimum standards for health and safety as set out in Ohio law on November 28^th. (It is not.)

The second and final footer concrete pour occurred on December 20^th, for the second half of the new footer, and was inspected by Maumee Division of Building, Inspection and Zoning inspector Robert ‘Mark’ Westcott as compliant with minimum standards for health and safety as set out in Ohio law on December 20^th. (It is not.)

At this point our home literally had no foundation walls at all under half of the house. DIVERSIFIED GROUP LLC worked the 20^th, 21^st, 22^nd and 23^rd putting walls under the house, however DIVERSIFIED GROUP LLC backfilled along the already inspected and approved back wall in the dark, in what seemed like a desperate bid to bury the evidence. So, we were very anxious and spoke with a contractor friend of ours who told us that under no circumstances should we allow any more backfilling to occur, and that a re-inspection by Maumee Division of Building, Inspection and Zoning would need to occur to clearly identify the defects in both construction and inspection.

On December 24^th, 2017 we sent an email to Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC informing them that we need to shut the job down until we meet at our home and discuss the progress thus far.

On the 29^th we had a meeting at our home with Terry Lengel and Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC.

We recorded audio of the conversation.

We informed Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC that we would need to shut the site down until such time as Maumee Division of Building, Inspection and Zoning comes out to re-inspect the work that had been completed up until that point.

We called Maumee Division of Building, Inspection and Zoning Chief Building Officer Bruce Wholf and explained the problems we had with the approval of the ‘plans’ by Zach Jenkins, in direct conflict with Ohio law and that Robert ‘Mark’ Westcott had gotten the first three inspections wrong. Bruce Wholf stated that he would send Zach and Mark back out. We implored Bruce to please not send the two employees that we were complaining about back out to our home. We pleaded with Bruce Wholf to please come out personally and just take a look at our foundation. Bruce refused.

On January 8^th, 2018 Zach Jenkins and Robert ‘Mark’ Westcott from Maumee Division of Building, Inspection and Zoning returned to our home for a re-inspection of the footers and foundation.

Present were two from DIVERSIFIED GROUPL LLC, Terry Lengel, our ‘sales rep’ and another man we were meeting for the first time ever. He said his name was Everette Stephens and that he was the ‘project manager.’ We asked him how it is that he is the ‘project manager’ on our project, at our home, and we are just now meeting and speaking for the first time. He had no explanation.

When we saw Zach and Mark arrive we were livid and we told the two of them in no uncertain terms that they made errors and they that their incompetence was causing us harm.

We provided them a document with every relevant O.R.C. code cut and pasted and how we felt that they did not comply with Ohio law. They both refused to even look at the information while at the house. They said they would take our concerns back to Bruce.

Neither Zach nor Mark re-inspected anything on January 8^th, however they did shut down work on our home until such time as the back corners of our home could be re-excavated to expose the partial first footer pour which had occurred on November 29^th.

Zach and Mark noted that our home was non-compliant, and work was stopped until such time as a re-inspection occurs of the excavated back corners. We were slightly baffled by the need for re-excavation since the problems with the footers and foundation is clearly evident any and everywhere you look.

Nearly a month later, on February 1^st, Bruce and Mark returned to our home to re-inspect our footers and foundation wall. Bruce Wholf cited 5 violations and issued 5 STOP WORK ORDER – “RED TAGS.” (We have never seen or received any “red tags”)

We never received lawful notification of these violations as outlined in the O.R.C.

On March 19^th we received our first mail from Maumee of any type. An envelope, regular mail, a notice dated February 5^th. Informing us we have thirty days to correct all violations. Also in the same envelope, another notice dated March 15^th. Informing us we had ten days to correct all violations.

This was not a lawful order, with required language omitted in violation of O.R.C.

Since March 19^th basically nothing has happened.

In May we received e-mail from Beth Tischler, city law director informing us that code enforcement may not be ‘appropriate’ in this case.

So Maumee Division of Building, Inspection and Zoning stopped work on our home on February 1^st and nothing has happened since.

Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC. Abandoned the job on December 23^rd and has not been back to work since.

Our foundation is incomplete the basement fills with water every time it rains. We had to remove the furnace and water heater from the basement so they would not be ruined. Animals enter through the holes in the walls to forage for food and defecate on the floor.

The City of Maumee is either unwilling or unable to follow Ohio law.

We have a complete timeline and records of everything. We have audio and video recordings and tens of thousands of photographs.

This is not “our opinion” or “our story.”

This is literally and figuratively carved in stone. Our foundation is still sitting under our home to be viewed and measured by anyone at anytime. The problems and code violation are so flagrant and egregious that they are impossible to miss by even the untrained eye.
