I have not had any contact with Diversified since we talked last time regarding the engineer.  I have not been any site visits since Mark and I met you there prior to the letter being sent to Diversified.  Plan re- submitted has not occurred to date.

I will check with Mark on when the letter was received.  Typically there is a 30 day response/appeal time limitation on the order issued.  I did not write the letter/violation.

I don’t believe they are planning a site visit, inspection only requires the engineer address the code issues.  The biggest concern was the frost protection and how that impacts the stability of the footings. They are working on multiple projects and said they should get to it “soon”.

Consumer’s Original Complaint :

We hired Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC to replace our foundation. Kevin took $14,900 dollars from us and never completed the work.

Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC took a $14,900 dollar down payment from us on October 24th, 2017 to replace the foundation on our newly purchased 110 yr old home in Maumee.

Red flags were present from the start when workers showed up without a building permit. Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC asked us if we could just put it on our porch or plumbing permit. We informed Kevin Oberhouse that that would not be possible.

Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC  didn’t seem to want to get a permit to perform the work.

We insisted that Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC  get a permit from Maumee Building Dept, which was their first ever permit in Whitehouse, Waterville or Maumee.

We began to notice problems soon after they started and when the job was inspected the entire project was RED TAGGED as not meeting minimum standards for our health and safety.

1) Foundation walls and footers shall be protected from frost. (Footers not deep enough, not below the frost line)

2) Foundation anchorage shall be set according to code.

3) Footer tiles shall be installed as per code.

4) Sump crock utilized for footer tile drainage shall be installed as per code.

5) Parging shall not be less than 3/8 inch in thickness.

6) Dowels (rebar) shall be placed / inserted in the footings and extend up into the wall.

After the city issued the STOP WORK ORDER DIVERSIFIED GROUP LLC basically abandoned the job. We have not seen or spoken with Kevin Oberhouse since December 29th. (today is March 21st.) Kevin has sent a few short emails, but has totally disregarded our questions and concerns.

The City of Maumee gave DIVERSIFIED GROUP 30 days to complete necessary repairs. That deadline has come and gone. The City of Maumee then issued a warning that if all necessary revisions are not completed in 10 days Kevin Oberhouse will be summoned to court to face misdemeanor charges.

We have spoken to law enforcement regarding possible felony fraud charges to be brought in response to the deceptive business practices of DIVERSIFIED GROUP LLC.

Kevin Oberhouse as well as DIVERSIFIED GROUP LLC employees have repeatedly told us things and made statements to us designed to get us to believe things that simply are untrue.

The proposal which we received from DIVERSIFIED GROUP LLC contained photographs that we assumed were of work they had completed. When we did a google image search of the images contained in their proposal we found that the images had been lifted off of other businesses websites.

It is now our belief that DIVERSIFIED GROUP LLC in fact not only never performed the work illustrated in the photographs used to sell us a $45,000 dollar foundation, they appear to have no idea who lived in the houses, nor did they have any idea who performed the work contained in the photographs they sent us in an effort to get us to contract with their company.

The contract they wrote up and we signed contains errors and untruths. The work DIVERSIFIED GROUP LLC wrote into the contract was either never completed or completed incorrectly.

In the original ‘plans’ the project called for the front house section of foundation to remain intact, in place. DIVERSIFIED GROUP LLC erroneously removed the entire section of our wall, that was to remain intact, un-disturbed.

DIVERSIFEID DROUP LLC connected the drainage tile to a crossover they sawed through our footer into our crawlspace and left the pipe unconnected to any drain, causing our basement to flood.

We were forced to remove the furnace and water heater from our basement so they would not be ruined by the rising waters.

We now have an incomplete foundation with holes in the walls where wild animals, we presume raccoons, now enter our home in the night to forage for food and create a mess. We cannot keep them out with no foundation walls.

DIVERSIFIED GROUP LLC has not been to our home to do any work since December 23rd, 2017.

Consumer’s Desired Resolution:

All we want and all we have ever wanted is a foundation that meets minimum standards for our health and safety.At this point it is doubtful that Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC is even capable of completing the job in a manner that will ensure minimum standards for our health and safety.If that is in fact the case then for starters we want a complete and total refund of the $14,900 dollars that was taken from us by Kevin Oberhouse d.b.a DIVERSIFIED GROUPL LLC under false pretenses.

         A late e-mail response consisting of as few words as possible, with no information and some lame excuse.

         24 words is all Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC could muster, LATE, PAST THE APRIL 1ST DEADLINE and what do the 24 words tell us? That he is waiting for an engineers report.

         We hired Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC because he told us he was an engineer.

         I guess we should have hired the engineer he hired.

         Typical of Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC the engineer he refers to was at our home last Friday March 30th. Several days past the City ordered deadline.

         Our home was declared non-compliant by The City of Maumee Building Inspectors on January, 8th. 85 days ago!

         It has been 95 days (Today is April 2nd.) since we have seen or spoken with Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC.

         It has been 102 days since anyone from DIVERSIFIED GROUP LLC has done any work at our home.

         The thirty day warning has past…

         The subsequent ten day warning has past…

         We are now waiting for Kevin Oberhouse’s court date in Maumee Court to answer why he refuses to follow state law, why he has abandoned the job, and why in light of the inferior and unsafe work performed by Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC has he kept our money.

         Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC states that they have been in business for 19 years and that he does 700 jobs a year.

         A search of all area building permits shows that Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC is only associated with approximately 10 building permits in all of that 19 years.

         The search also shows that in that same 19 years and 10 permits are a total of 13 RED TAG / STOP WORK ORDERS.

         MORE STOP WORK ORDERS THAN PERMITS is never an indication of a contractor you want to do business with.

         700 jobs a year multiplied by 19 years is 13,300 jobs performed with only 10 associated permits.

         No contractor anywhere can claim that they are an upstanding / reputable business when their record of complying with state law is so dismal.

         In December we spoke with Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC a few times and we have tape recordings of those conversations.

         You can hear Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC repeatedly telling us falsehoods in an order to try to get us to believe things that are simply untrue, and that is the O.R.C. definition of FRAUD.

         We are waiting for the first court date.

04/09/2018           WEB        BBB  RECEIVED BUSINESS’ REBUTTAL RESPONSE : Below is our side of the story. Even though we are 85% completed. We would like to invite the owner to a mediation via the BBB standards to settle the disagreement.

          Diversified Group LLC went above and beyond what is required by code. The block, footings, waterproofing and reinforcement are all far above the minimum requirements. This was all submitted by Diversified Group LLC to go above and beyond the expectations of the owner. This was at no additional cost to the owner and only the minimum standard was contracted.  It is like if your mom said you need a raincoat and you put on three. Then she is not happy that you didn’t button the first coat to the top.

         We were completing the foundation in two phases the second phase was inspected (via request of owner) before being completed. The owner stopped us on 12.20.17 and then told Inspection to tell Diversified Group LLC on 1.17.18 not to continue as they were hiring a structural engineer.

         Inspection Log –

         “Inspector Mark Westcott called home owner Meagan and were informed that she plans to

         hire a structural engineer to assess her property at 321 W. Broadway. She also

         requested that we inform the contractor that they should cease all work at the property

         until she informs them otherwise. We then called Diversified Group and informed them

         of the home owners decision.”

         The homeowner is also very abrasive and combatant to us and the inspection office.  After we had a majority of the work completed her male companion said they would have inspection put a stop work order on it and “Everything will be FXXkin removed.”

         Additional Inspection Notes Below –

         “Mark and myself meet out on the jobsite with the homeowner and

         her friend. The male was very abrasive. He used a lot of foul language. he was

         concerned about the foundation repair to the lady’s home.”

         The homeowner then  requested a whole home inspection. This included phase two which we were not completed with. We then got a letter stating the following violations.

         “1) Foundation walls and footers must be protected from frost. ORC

         403.1.4.1  (DG Response – The owner had us stop work on 12.20.18 and directed by Mark to protect his property) Although we do not agree diversified Group LLC should be held accountable after directed to stop any work, we still had AA Engineers complete an inspection of the footers at our expense.)

         2) Footer tiles shall be installed as per code. ORC 405 (DG Response – inspection for whole house which was still in progress)

         3) Sump crock utilized for footer tile drainage shall be installed as per

         code. ORC 405.2.3 (DG Response – not on permit and not contracted to Diversified Group LLC by owner, the owner made preparations to  get water out of their basement, this is an item that could easily be completed.)

         4) Parging shall be not less than 3/8&quot; in thickness. ORC. 406.1 (DG Response – inspection on whole house which was still in progress, again all parging can easily be rectified.)

         5) Foundation anchorage must be set according to code. ORC 403.1.6  (DG Response – pre approved on permit and alternate documentation coming from supplier)

         6) Dowels/rebar shall be placed/inserted in the footings and extend up into

         the wall. ACI 18.5  (DG Response – inspection on whole house which was still in progress and lose rebar were extra in additional areas not even required but instead of having extra materials we put “extra bars” in.)

         The owner has since filed this BBB claim and said he does not want us to complete any more work (For the third time). The owner has also called the police stating we are trying to commit fraud. We have over 550 confirmed man hours via GPS locating services plus materials, fraud in this case is unreasonable and vicious. Even at a modest shop rate we have over 40k invested in the homeowners repairs. The owner gave us 13k as a down payment.

         At this point, and based on what was asserted in the BBB complaint and 3 times they told us not to work, it is evident that the homeowners no longer want us to return to the project, but instead are looking for a refund, and want to use an inspection report a leverage to get it.  Under normal circumstances, we would be happy to return to the project and make reasonable corrections, but I fear that the relationship has soured to the point that we will never be able to satisfy this homeowner.  Our preference would be to negotiate a fair termination to the contract, and another contractor can finish the work.

          We would like to invite the owner to a mediation via the BBB standards to settle the disagreement and go our separate ways.

04/10/2018                  BBB  MORE INFO RECEIVED FROM THE CONSUMER : On 032118 we filed a complaint with the Better Business Bureau.

         The BBB sent the complaint to Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC and the BBB informed Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC that he has until April 1st to respond to our complaint.

         April 1st came and went with NO RESPONSE from Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC!

         On April 2nd, after the deadline, Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC responded with a short 24 word email: (copied below)

         So, let’s take a look at the response Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC sent to the BBB, a day late and fourteen thousand, nine hundred dollars short.

         The first thing we notice is the date and time: “Date: Mon, Apr 2, 2018 at 8:20 AM.”

         This is unarguably late, non-compliant and beyond the deadline.

         Now, what does Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC have to say?

         “I am waiting on an engineers report.”

         ********

         The engineer was at our home on March 30th, past the thirty day, City of Maumee imposed deadline for having all of the corrections completed.

         We are left to assume that the engineers report never arrived as it has never been mentioned again.

         We are left to assume that it has been IMPOSSIBLE for Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC to give a response.

         “and definitely before the 9th.”

         Today’s date is the 10th, unarguably past the 9th.

         What can we learn, first from Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC late and subsequent nonexistent responses?

         First, that “definitely” apparently means something different to Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC than it does for the rest of us.

         Second, that when Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC tells you he will definitely do something, he is definitely insincere and that he is definitely telling you things that are patently false in an attempt to definitely get you to believe things that definitely are not true.

         The City of Maumee declared the work on our homes foundation to be “non-compliant” on January 8th.

         The City of Maumee issued six STOP WORK ORDERS on February 1st.

         The 30 day deadline for having all corrections completed expired on March 7th.

         The 10 day deadline for having all corrections completed expired on March 29th.

         We have not spoken to Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC since December 29th, when the last words he said to us were;

         “I guess I don’t have to come up with a plan, then do I?

         He definitely has not spoken one word to us since.

         Our home has definitely been declared a public nuisance.

         We are waiting for Kevin Oberhouse d.b.a DIVERSIFIED GROUP LLC’s first court date to answer charges.

         (B) “Defraud” means to knowingly obtain, by deception, some benefit for oneself or another, or to knowingly cause, by deception, some detriment to another.

         “…you were saying something about best intentions. What’s the matter?

         Oh, you were finished!

         Well, allow me to retort…”

         Let’s take a look at the late response, word for word, from Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC.

         KO – “Below is our side of the story.”

         There are not two sides to this story, there is only one side, the side of verifiable fact and truth.

         This is not a difference of opinion.

         This is not conjecture.

         This is not speculation.

         This is not a case of he said, she said.

         This is not hearsay.

         The verifiable fact and truth here is figuratively and quite literally carved in stone!

         The word ‘completed’ could be viewed as misleading.

         We do not dispute that work has been ‘completed’.

         Our foundation was removed and block was placed under our home, however the work that has been ‘completed’ is not ‘completed’ and all needs to be removed and redone.

         So has anything really been ‘completed’?

         KO – We would like to invite the owner to a mediation via the BBB standards to settle the disagreement.

         KO – “Diversified Group LLC went above and beyond what is required by code.”

         This is a lie. This is Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC knowingly deceiving another or causing another to be deceived by a false or misleading representation.

         This is conduct and action on the part of Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC that creates, confirms, or perpetuates a false impression in another.

         The problems we are complaining about and the violations the City of Maumee Building Inspection Department cited Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC for are all sitting under our home, and can be independently viewed and measured by anyone and everyone at anytime. (please phone ahead)

         We fear the list of all the defects involved with this job are too numerous and complex to fully address in this rebuttal, so I am going to repeat our aforementioned invitation.

         The problems we are complaining about and the violations the City of Maumee Building Inspection Department cited Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC for are all sitting under our home, and can be independently viewed and measured by anyone and everyone at anytime. (please phone ahead)

         KO – “This was all submitted by Diversified Group LLC…”

         Submitted to whom? Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC never submitted anything to us.

         The information Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC submitted to Maumee Building Inspection did not meet minimum standards, yet were erroniously approved by Maumee Building Inspection in direct conflict with Ohio law.

         This is the totality of all information submitted by Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC to Maumee Building Inspection for plan approval.

         Block courses will very from crawl – basement sections.

         12″ x 8″ concrete footing.

         Core filled every 3′.

         Parge walls of dry – stacked block.

         Tie down straps as anchors 6′ OC.

         New treated sill plate.

         Porch to be removed by homeowner.

         That is it. Those words were scrawled by hand on a photocopy of the AREIS printout of our property, next to a sketch of a stack of 4 blocks stacked atop one another.

         KO – “to go above and beyond the expectations of the owner.”

         I don’t want to debate your thoughts or emotions, however we will say that you tragically missed the mark.

         KO – “This was at no additional cost to the owner and only the minimum standard was contracted.”

         What was at no additional cost to us, the block, footings, waterproofing and reinforcement?

         Do you mean no additional cost on top of the $14,900 dollars you took from us, or the remaining $25,000ish dollars we agreed to pay you for successful completion of our contract?

         Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC knows that we phoned him on December 22nd at 09:04 with questions regarding the exterior waterproofing extending past grade, all the way up to the sill plate.

         We have a recording of that phone call, where you can hear Kevin Oberhouse d.b.a. DIVERSIFIED GROUP LLC knowingly deceiving us, causing us to be deceived by false or misleading representations, by withholding information and by preventing us from acquiring information.

         Hi Megan, i am getting a lot of calls from the guys regarding the grade. Many homes are built with the grade too high and moisture resistance materials must be used or cover up non moisture resistant materials. It is always a bad idea to grade your property toward your home the very back of the addition maybe practical to grade it towards the neighbors and lower it. It is definitely not practical for the area where the cistern is. I will reach out to inspection on Tuesday (12/26/17) to verify the situation and correction. We run across this all the time and generally the answer is to cover the wall under the siding with a moisture barrier to protect the wood behind it. Again, I will verify with inspection on Tuesday.
